Hardware / Peripherals

It is the sole responsibility of the customer to ensure all hardware and peripherals (the "Materials") are maintained to an acceptable level in order for any software to operate effectively and for such software to be installed in a safe manner.

The level of maintenance is deemed adequate for this purpose is to be determined by the Elysia personnel carrying out the work.

Elysia reserve the right to refuse to work on any Materials or in any environment deemed unsafe by Elysia, its agents or subcontractors.

Personal / Organisational Data & Information

Save as agreed to the contrary by Elysia it is the sole responsibility of the customer or to ensure the relevant data is backed up and secure prior to any work being carried out by Elysia personnel. Elysia will not be liable for any data loss resulting from work carried out by Elysia or its personnel, agents or subcontractors.

Limitation of Liability

In the event of loss of data or damage to any Materials caused by Elysia’s negligence, Elysia shall be given the opportunity to recover such data or repair such damage. In the event such damage is not capable of repair, Elysia shall replace such Materials within 28 business days of agreement that the Materials are not replaceable. The cost of such replacement shall not exceed the value of the materials

To the fullest extent permitted by applicable laws, and except in respect of death or personal injury arising from Elysia’s negligence, Elysia hereby excludes liability for any claims, loss, demands or damages of any kind whatsoever with respect to the Materials including, without limitation, direct, indirect, incidental or consequential loss or damages, whether arising from loss of profits, loss of revenue, loss of data, loss of use or otherwise and whether or not the possibility of such loss has been notified to Elysia. The foregoing will apply whether such claims, loss or damages arise in tort, contract, negligence, under statute or otherwise.
